Applicants must:
- Be at least 18 years old.
- Provide accurate and current information.
- Maintain an active email address.
- Comply with all applicable laws and regulations.
- Comply with this Agreement at all times.
4. Independent Contractor Relationship
Affiliates are independent contractors. Nothing in this Agreement creates an employment, partnership, agency, franchise, joint venture, or fiduciary relationship, or any authority to act on behalf of Wealth Magick.
Affiliates may not represent themselves as employees, partners, or official representatives of the Company.
5. Eligible Products and Commission Structure
5.1 Eligible Products
Commissions are paid only on products specifically designated by the Company as commissionable. Eligible products and commission percentages may be updated periodically. The Company reserves the right to modify, add, or remove eligible products at any time.
5.2 Commission Structure
Current commission rates are:
- Wealth Magick Mastery — 10%
- Other products, if any added to the affiliate program — 10%
Commission percentages may be modified upon reasonable notice. Future promotional campaigns may include temporary commission adjustments.
6. Qualified Sales and Payments
6.1 Qualified Sales
A commission is earned only when the customer purchases through the Affiliate's unique Affiliate Link, payment is successfully completed, the payment is not fraudulent, the purchase is not refunded, the transaction remains in good standing, and all program requirements have been satisfied. The Company's tracking platform shall determine whether a sale qualifies for commission.
6.2 Commission Payments
Commissions are paid monthly. Payments are issued only after applicable refund periods have expired, payment processors have cleared funds, and any fraud reviews have been completed.
Minimum payout threshold: $50 USD. Balances below the minimum threshold roll over to future payment periods.
If required by applicable law, the Company may require a completed IRS Form W-9, W-8, or other tax documentation before processing affiliate payments. Failure to provide requested tax documentation may result in delayed or withheld payouts until such documentation is received. Affiliates are solely responsible for all taxes arising from affiliate earnings.
6.3 Refunds, Chargebacks, and Cancellations
No commission is earned on refunded purchases, disputed transactions, fraudulent transactions, chargebacks, reversed payments, duplicate orders, test purchases, or self-referrals if prohibited by Company policy.
If commission has already been paid on a transaction later refunded or reversed, the Company may deduct the amount from future commissions.
7. Ethical Marketing Standards
7.1 Promotional Conduct
Affiliates agree to promote Wealth Magick honestly, professionally, and in good faith. Affiliates shall not make misleading statements; falsely represent personal experience; impersonate Company representatives; create deceptive scarcity; use false testimonials, fake reviews, or purchased engagement; or engage in spam. Marketing must accurately represent the educational nature of Wealth Magick's products and services.
7.2 No Guaranteed Outcomes
Affiliate shall not state, imply, or suggest that Wealth Magick's products or services guarantee financial success, income, wealth, business growth, manifestation results, healing or therapeutic outcomes, personal transformation, supernatural results, or any other specific life outcome. Affiliate may share honest personal experiences but shall not represent those experiences as typical or guaranteed.
Affiliate shall not encourage any individual to discontinue professional medical, psychological, legal, or financial advice; represent Wealth Magick products as a substitute for licensed professional services; encourage unsafe practices; or intentionally distort the Company's teachings to increase sales.
The Company reserves the right to require the removal or correction of any promotional material that does not comply with this Section.
7.3 Required Disclosures
Affiliates are responsible for complying with all applicable advertising and consumer protection laws. Where required, Affiliates must clearly disclose the affiliate relationship, including compliance with applicable Federal Trade Commission (FTC) endorsement guidelines and any other applicable local laws.
7.4 International Affiliates and Cross-Border Compliance
Affiliates located outside the United States, or who direct promotional activity toward audiences outside the United States, are responsible for complying with the advertising, consumer protection, and endorsement disclosure laws of their Territory, in addition to the requirements described in Section 7.3.
Affiliate represents and warrants that Affiliate is not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive sanctions administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), and is not identified on any applicable restricted-party or denied-persons list.
Commissions are calculated and paid in U.S. dollars unless otherwise stated by the Company. Affiliate is solely responsible for any currency conversion costs, international transfer fees, and withholding or other taxes imposed by Affiliate's Territory.
This Agreement is executed in the English language. Any translation provided for convenience shall not govern, and the English-language version shall control in the event of any conflict.
8. Brand Guidelines and Intellectual Property
8.1 Use of Company Marks and Materials
Affiliate may use Company-approved logos, graphics, product descriptions, images, promotional materials, and trademarks. Affiliate agrees to accurately represent the Company's products, services, and mission, and shall not alter Company branding in a misleading manner; create confusingly similar logos or domain names; create fake social media accounts representing Wealth Magick; or imply an official partnership beyond participation in the Affiliate Program.
8.2 Brand Reputation and Conduct
Affiliate shall not engage in marketing that is deceptive, manipulative, fear-based, harassing, discriminatory, hateful, sexually explicit where unrelated to the Company's products, or intentionally inflammatory for engagement purposes, or otherwise likely to damage the Company's reputation. 8.3 Intellectual Property Ownership
All content, products, courses, frameworks, graphics, logos, trademarks, videos, written materials, methodologies, and educational resources remain the exclusive property of Wealth Magick. Participation in the Affiliate Program grants only a limited, revocable, non-exclusive license to use approved promotional materials solely for authorized affiliate marketing. 13. Term and Termination
13.1 Termination
Either party may terminate this Agreement at any time. The Company may immediately terminate participation for fraud, deceptive marketing, violation of this Agreement, illegal conduct, misuse of Company intellectual property, conduct damaging to the Company's reputation, or any other material breach.
Termination does not affect accrued obligations or rights that survive termination.
13.2 Non-Disparagement
Affiliate agrees not to make, publish, or communicate any defamatory, negative, or disparaging remarks, comments, or statements — whether oral, written, or electronic — about the Company, its officers, directors, employees, or products.
During participation in the Affiliate Program, and following termination, Affiliate agrees not to knowingly publish false statements about the Company, its owners, employees, products, or services that are intended to materially harm the Company's reputation.
Nothing in this Agreement prohibits Affiliate from making truthful statements required by law or participating in protected legal activity.

14.1 Investigation of Violations
The Company reserves the right to investigate suspected violations of this Agreement. If no violation is found, withheld commissions shall be released according to the Company's normal payment schedule.
14.2 Audit Rights
The Company reserves the right, upon reasonable notice where appropriate, to review affiliate marketing activities, promotional methods, and traffic sources for the limited purpose of verifying compliance with this Agreement. Affiliate agrees to cooperate with reasonable compliance inquiries.
14.3 Program Modifications
The Company may modify commission percentages, eligible products, payout schedules, promotional policies, application requirements, affiliate resources, or other aspects of the Affiliate Program. Material changes will become effective after reasonable notice to Affiliates. Continued participation constitutes acceptance of the updated terms.

15.2 No Earnings Claims

Affiliate acknowledges that earnings depend upon numerous factors outside the Company's control, including audience, marketing efforts, experience, market conditions, and consumer demand. Past performance does not guarantee future results.
16. Limitation of Liability
16.1 Cap on Liability
To the fullest extent permitted by applicable law, the Company's total liability arising out of this Agreement shall not exceed the total commissions paid to the Affiliate during the twelve (12) months preceding the event giving rise to the claim. Exhibit A
Data Processing Addendum
This Data Processing Addendum ("DPA") supplements the Wealth Magick Affiliate Program Agreement (the "Agreement") and applies only to the extent a party processes Personal Data on behalf of the other party in a manner subject to Applicable Data Protection Law. Capitalized terms not defined in this DPA have the meaning given to them in the Agreement.
A.1 Roles of the Parties
Each party will independently determine the purposes and means of its own processing of Personal Data relating to its own business operations (for example, the Company's processing of customer Personal Data, or Affiliate's processing of Personal Data collected through Affiliate's own marketing channels), and each acts as an independent Controller with respect to such processing.
To the extent either party processes Personal Data solely on behalf of, and under the documented instructions of, the other party (for example, where Affiliate submits lead information directly to the Company's systems for processing), the party receiving such instructions acts as a Processor, and Section A.2 (Processor Obligations) applies to that processing.
A.2 Processor Obligations
Where a party acts as Processor under this DPA, it shall:
- process Personal Data only on the documented instructions of the Controller, unless otherwise required by law;
- ensure personnel authorized to process Personal Data are subject to confidentiality obligations;
- implement appropriate technical and organizational measures to protect Personal Data against unauthorized or unlawful processing and against accidental loss, destruction, or damage;
- not engage a sub-processor without the Controller's authorization, and remain responsible for any sub-processor's compliance with this DPA;
- taking into account the nature of the processing, reasonably assist the Controller in responding to data subject requests and in meeting its obligations regarding security, breach notification, and data protection impact assessments;
- notify the Controller without undue delay after becoming aware of a Personal Data breach affecting the Controller's Personal Data;
- at the Controller's choice, delete or return all Personal Data to the Controller upon termination of the Agreement, unless applicable law requires retention; and
- make available information reasonably necessary to demonstrate compliance with this DPA and allow for audits, including inspections, conducted by the Controller or its authorized auditor, subject to reasonable notice and confidentiality protections.
A.3 International Transfers
Where Personal Data subject to the GDPR, UK GDPR, or similar law is transferred to a country that has not been recognized as providing an adequate level of data protection, the parties agree that such transfer will be subject to an appropriate transfer mechanism recognized under Applicable Data Protection Law, such as the Standard Contractual Clauses adopted by the European Commission, or the UK International Data Transfer Addendum, as applicable, which are incorporated by reference and shall apply to the extent required.
A.4 Affiliate Obligations as Independent Controller
Where Affiliate collects Personal Data directly from prospective customers (for example, through Affiliate's own website, landing pages, or opt-in forms) before referring such individuals to the Company, Affiliate acts as an independent Controller of that Personal Data and is solely responsible for providing all legally required notices and obtaining all necessary consents prior to disclosing such Personal Data to the Company.
A.5 Liability and Precedence
Each party's liability arising under or in connection with this DPA is subject to the limitations of liability set forth in Section 16 of the Agreement. In the event of a conflict between this DPA and the Agreement regarding the processing of Personal Data, this DPA controls.
A.6 Term
This DPA remains in effect for as long as the Company or Affiliate processes Personal Data on behalf of the other party in a manner subject to Applicable Data Protection Law, notwithstanding termination of the Agreement.
